Special wage protections for remote workers in Illinois

Remote work has become common across many industries. To accommodate this shift, Illinois wage laws provide specific protections for remote employees. 

 

These laws ensure that workers receive fair pay, overtime and reimbursement for certain expenses related to working from home. Understanding these protections helps remote workers safeguard their rights.

Overtime rules for remote workers

Illinois remote workers must receive overtime pay if they work more than 40 hours in a week. The Fair Labor Standards Act (FLSA) and the Illinois Minimum Wage Law require employers to pay time-and-a-half for overtime hours. Remote employees should accurately track their work hours to ensure they receive proper compensation. Even if employees perform work outside of regular business hours, employers must pay for all time worked.

Expense reimbursement for remote work

Illinois law requires employers to reimburse employees for work-related expenses. For remote workers, this may include costs for internet, phone use, office supplies and other necessary items. The Illinois Wage Payment and Collection Act states that employees must submit expense reports to receive reimbursement. Employers must provide reasonable reimbursement when there are necessary expenses to perform job duties.

Breaks and meal periods for remote employees

Remote workers have the same rights to breaks and meal periods as on-site employees. Employees who work at least 7.5 hours in a day must receive a 20-minute unpaid meal break. This break must occur no later than five hours into the work period. Additional short rest breaks may also be necessary, depending on the nature of the job.

 

Remote employees in Illinois should report any wage violations to the Illinois Department of Labor. This agency enforces wage laws and can investigate complaints. Workers who do not receive proper wages or reimbursement have the right to seek compensation under state law.
